关于警惕“取得宗教法人有利于获取在留资格或永住许可”等虚假宣传的提醒

現在、宗教法人の売買に類似した取引(※)に関する情報が国内外のウェブサイトやSNS等に掲載されています。特に、これらの情報を掲載する海外のウェブサイト・SNS等において、「在留資格(ビザ)が必要な方大歓迎です」「在留資格(ビジネスビザ)、さらには日本への移住にも適しています」というような謳い文句が使用されていることが、文化庁が行った調査により分かっています。

しかし、「日本の法人の代表である」という身分のみでは、在留資格は取得できません。あくまで、日本でどのような活動をするのか、という観点で審査が行われます。

例えば、「経営・管理」の在留資格は、事業に関連する学位(修士以上)又は経営・管理経験年数が3年以上である等、自身も経営に関する専門の知識を有している必要がある他、常勤職員の雇用などが必要になるため、どのように日本で事業をし、経済活動を行うのか、という点が審査対象であり、日本の宗教法人の代表であるだけで在留資格が取得できるものではありません。

「宗教」の在留資格は、外国の宗教団体からの布教を目的としたものであるため、日本の宗教法人の代表役員になることで取得できるものではありません。

永住許可に関しても、日本の宗教法人の代表役員であることは特段積極要素にはなりません。

また、そもそも宗教法人の売買に類似した取引により、宗教活動を目的としない第三者が宗教法人の代表役員の地位等を得る行為は、脱税やマネー・ローンダリング等の違法行為に悪用される等して、宗教法人格が不正に利用されるおそれがあるとして、政府において対策を強化しています。宗教法人法は、宗教活動以外の目的に法人格を利用する事態をそもそも想定しておらず、元来の宗教活動を継続・継承する意思のない第三者が法人格を取得する行為は、法の目的に合致しないものです。

宗教法人の売買に類似した取引を扱う事業者は、宗教法人格の不正利用に当たることを認識したうえで行っている可能性もあり、宣伝に際して、上記のような虚偽の内容を記載している場合も存在するため、以上注意喚起いたします。

※「宗教法人の売買に類似した取引」とは、宗教法人の代表役員の地位、その他の実質的に法人の運営に対して深い影響を及ぼす法人内の地位を、寄附等、金銭その他の財産上の利益を与えることにより、取得する取引行為のことを指します。

Information regarding transactions similar to the buying and selling of a religious corporation* is currently being posted on websites and social media platforms both in Japan and overseas. In particular, a survey conducted by the Agency for Cultural Affairs has revealed that claims such as “We warmly welcome those who need a status of residence (visa),” and “Ideal for those seeking a status of residence (business visa) or relocation to Japan,” have been used on overseas websites, social media platforms, and similar channels.

However, the status of “representative of a Japanese corporation” alone is not sufficient to obtain a status of residence. Decisions regarding status of residence (visas) are made solely based on the nature of the activities that the applicant will conduct in Japan.

For example, to obtain the “Business Manager” status of residence, an applicant must possess specialized knowledge in management (such as a degree related to business (master’s degree or higher) or at least three years of experience in management) and must also meet other requirements, such as employing full-time staff. Consequently, the decision process evaluates how the applicant intends to conduct business and engage in economic activities in Japan. As such, simply being the representative of a Japanese religious corporation is not sufficient to obtain this status of residence.

The “Religious Activities” status of residence is intended for missionary work by foreign religious organizations, and therefore cannot be obtained by becoming a representative officer of a Japanese religious corporation.

Similarly, serving as a representative officer of a Japanese religious corporation confers no particular advantage when applying for permanent residence.

Furthermore, if, through a transaction similar to the buying and selling of a religious corporation, a third party with no intention of conducting religious activities acquires the post of a religious corporation’s representative officer, etc., there is a risk that the legal personality of the religious corporation may be improperly used for illegal acts including tax evasion and money laundering. Consequently, the government is strengthening its countermeasures accordingly. Japan’s Religious Corporations Act does not contemplate a situation where the legal personalities of religious corporations are used for purposes other than religious activities, in the first place. Therefore, the acquisition of the legal personality of a religious corporation by a third party with no intention of continuing or inheriting the original religious activities is inconsistent with the purpose of the law.

Businesses that handle transactions similar to the buying and selling of religious corporations may be doing so with the knowledge that such actions constitute misuse of religious corporation status; furthermore, some may present false information, such as that described above, in their advertising. This public notice is issued to raise awareness of these issues.

* “A transaction similar to the buying and selling of a religious corporation” refers to a transaction in which a person acquires the post of a religious corporation’s representative officer, etc., that in substance has a significant influence over the corporation’s management, by providing donations or other monetary or economic benefits.

根据文化厅的调查,近期国内外互联网站及社交媒体(SNS)上已出现类似宗教法人买卖的交易(※)的信息。特别是在发布此类消息的海外网站及社交媒体上,出现了“热烈欢迎需要在留资格(签证)的人士”“适用于获取在留资格(商务签证)及移居日本”等宣传语。

然而,仅凭“日本法人代表”的资格并不能取得在留资格。审查主要是根据申请人在日本从事何种活动来进行的。

以“经营·管理”在留资格为例,其不仅要求申请人本人具备经营相关专业知识,如具有与该事业相关的学位(硕士以上)或3年以上经营、管理经验等,还须满足雇佣正式员工等法定要件。因此,审查的要点在于如何在日本运营事业和开展经济活动,仅凭日本宗教法人代表的身份并不足以取得在留资格。

“宗教”的在留资格则以外国宗教团体的传教活动为目的,若仅成为日本宗教法人的代表役员,并不符合该资格的取得要件。

此外,就永住许可而言,身为日本宗教法人代表役员也不构成特别有利的因素。

此外,不以宗教活动为目的的第三者,通过类似宗教法人买卖的交易方式获得宗教法人的代表役员地位等,该行为本身即存在非法利用宗教法人格的风险,例如被恶意用于逃税、洗钱等违法行为。政府对此已加强相关应对措施。宗教法人法本就没有设想将法人格用于宗教活动以外目的的情形,不具有继续或承继原有宗教活动意愿的第三者取得法人格,不符合该法的立法目的。

从事类似宗教法人买卖的交易的经营者,有可能在认识到相关交易构成对宗教法人格的不当利用的情况下,仍从事此类交易。其在宣传过程可能刊登上述虚假内容,故特此进行以上提醒。

※“类似宗教法人买卖的交易”指通过提供捐赠、金钱及其他财产性利益,以取得宗教法人的代表役员地位,或取得其他实质上对法人运营产生重大影响的法人内部地位的交易行为。
